This policy covers American Capital Funding Group, trading as The ACF Group (“ACF”, “we”, “us”) and the site at theacfgroup.com, including the funding request form and the secure application.

What we collect on this site

When you use the funding request form we collect what you enter: your business name, your name, your email address, your mobile number if you choose to give one, and the details of the request itself — what the funding is for, roughly how much you are looking for, roughly what your business deposits in a month, and when you need it.

Your mobile number is optional. The form works without it.

We also record the fact and time of your submission.

What we collect if you complete an application

A funding application asks for materially more, because underwriting requires it: your Employer Identification Number, Social Security Number, date of birth, home and business addresses, ownership percentage, credit score range, any funding positions you currently carry, and your last four months of business bank statements.

You upload statements directly to the secure application page. Do not email them.

Credit checks

We run a soft credit inquiry to review your options. A soft inquiry does not affect your credit score and is not visible to other lenders.

If a funding partner later needs a hard inquiry, that only happens with your separate agreement, and it is disclosed to you first.

Text messages

If you give us a mobile number, you agree we may text you about your funding request, including by automated means. Message and data rates may apply. Message frequency varies.

Reply STOP to any message to opt out. Reply HELP for help. Consent to receive texts is never a condition of getting funding, and we do not sell or share your mobile number with third parties for their own marketing.

If you do not give a mobile number, we do not text you.

Why we collect it

To review your request and tell you what funding is available to you; to reach you about that request; to meet our legal, anti-fraud and record-keeping obligations; and to run and secure our own systems.

We do not sell your personal information.

Who we share it with

Funding partners. When your request sits outside what we fund ourselves, we share your file with bank and private-capital partners so they can review it. We share what underwriting requires and no more.

Service providers. Companies that operate parts of our service on our behalf — messaging, email, hosting, document handling, identity and carrier verification. They may only use your information to provide that service to us.

Legal. Where we are required by law, subpoena or regulator, or to investigate fraud or protect our rights.

We do not sell your personal information, and we do not share it with anyone for their own advertising.

How long we keep it

We retain funding requests and applications for as long as needed to provide the service and to satisfy legal, tax, audit and anti-fraud record-keeping requirements. Records connected to a funded transaction are kept longer than records connected to a request that went nowhere.

Your choices

You can ask us to tell you what personal information we hold about you, correct it, or delete it. You can withdraw consent to texts at any time by replying STOP. You can ask not to be contacted at all.

Depending on where your business and you are located, state law may give you additional rights — including in California, Colorado, Connecticut, Texas, Virginia and other states with comprehensive privacy laws. We honour those rights regardless of where you live.

Security

Applications and document uploads are transmitted over an encrypted connection, and access to submitted files is restricted to staff who need it to do their job.

No system is perfectly secure, and we will not claim otherwise. If a breach affects your information we will notify you as the law requires.

Cookies and tracking

This site uses only what is needed to make the pages work. We do not run third-party advertising trackers on it.

Children

This is a service for businesses. It is not directed to anyone under 18, and we do not knowingly collect information from them.
